John H. MacConaghy
John MacConaghy has over 25 years experience in insolvency, bankruptcy, and reorganization matters
for debtors, bankruptcy trustees, creditors, and court appointed committees, in real estate, construction,
agricultural, wine, retail, manufacturing, securities, and high technology industries throughout Northern California.
He has confirmed over 50 debtor and creditor Chapter 11 Plans, and has extensive bankruptcy court trial and appellate
experience. He has been lead counsel in a number of significant published decisions, including In re San Rafael Baking
Co. 217 BRW 970 (9th Cir. BAP 1998), In re Carraher 971 F.2d 327 (9th Cir.1992), In re Kirkland 915 F.2d 1236 (9th Cir.1990),
In re Marino 813 F.2d 1562 (9th Cir.1987), and In re Daniel 771 F.2d 1352 (9th Cir.1985) cert. denied. 475 US 1016.
Mr. MacConaghy has been certified as a Bankruptcy Law Specialist by the State Bar of California since 1995. He has served as a member (1999-2004) and Chair (2003-2004), of the Bankruptcy Law Advisory Commission, State Bar of California Board of Legal Specialization, the entity which drafts and grades the test and otherwise evaluates applicants for certification and recertification as State Bar Certified Specialists. His other professional activities include service as a Director of the Bay Area Bankruptcy Forum; and one of nine attorney members of the Bench-Bar Liaison Committee, U.S. Bankruptcy Court for the Northern District of California. He is a frequent lecturer on bankruptcy topics for the Alameda, Contra Costa, and Sonoma County Bar Associations and the Credit Manager's Association of Northern California.
Mr. MacConaghy's public service activities include service as an elected director of the Sonoma Valley Health Care District and as President of The Sonoma Valley Law Center, a non-profit legal aid service for indigent area residents. He also serves as an arbitrator for the Sonoma County Superior Court.
Mr. MacConaghy obtained his law degree in 1978 from the University of California, Hastings College of the Law, and has a B.A. in Economics from the University of California at Berkeley.
Jean Barnier
Since joining the firm in 2003, Jean Barnier has focused on the representation of Chapter 7 bankruptcy trustees, with a particular emphasis on the investigation and prosecution of claims arising out of debtor fraud. Ms. Barnier has handled a broad range of other types of complex bankruptcy court litigation, including prevailing over the State of California in an extensively briefed issue of sovereign immunity and successfully prosecuting numerous preference, fraudulent transfer and other avoidance actions.
Ms. Barnier came to the practice of law after successful careers as an investigative journalist and television news producer and as a high school English and history teacher.
She obtained her law degree in 2003 from Empire College of the Law. She also holds a M.S. in Journalism from Northwestern University and a B.A. in Government from Mills College.
Monique Jewett-Brewster
Monique Jewett Brewster is an associate with MacConaghy & Barnier and has extensive experience in the field of bankruptcy law, having had the invaluable opportunity to work closely with several Bankruptcy Judges both during and after law school. Prior to joining MacConaghy & Barnier, Ms. Jewett-Brewster honed her practice at one of the world's largest law firms, where she focused her practice on the enforcement of creditor's rights and remedies upon default and defending against actions to recover preferential transfers, and represented both unsecured and secured creditors in state and federal district and bankruptcy courts nationwide. She also has experience negotiating workouts and restructurings of large ticket leases, secured loans and guaranty transactions. Her past clients include banks and other financial institutions, factors, and commercial landlords.
Ms. Jewett-Brewster is a graduate of the University of San Francisco (B.A. in Politics, with a Minor in Japanese, 1998), and the University of Southern California School of Law (J.D., 2001), where she served as Publication Editor for the Review of Law and Women's Studies honors journal. While in law school, Ms. Jewett Brewster served as a court extern for three United States Bankruptcy Judges for the Central District of California: the Honorable Alan M. Ahart, the Honorable Ellen Carroll, and the Honorable Kathleen P. March. After graduating from U.S.C School of Law, Ms. Jewett-Brewster completed a two year clerkship in the champs of the Honorable Meredith A. Jury, United States Bankruptcy Judge for the Central District of California, and member of the Bankruptcy Appellate Panel for the Ninth Circuit Court of Appeals.
Civically minded, Ms. Jewett-Brewster serves as Secretary for the Financial Women's Association of San Francisco, a professional organization with over 450 members working in the field of finance or financial services, and is a director for the Bay Area Bankruptcy Forum. Dedicated to serving her community, Ms. Jewett-Brewster served as a panelist for the Alameda County Bar Association's "Mortgage Meltdown" continuing legal education program, and regularly publishes articles on current legal developments in bankruptcy and state law.
